1. General
1.1 At "modelling4u" we believe it
is helpful, and in some cases necessary, to establish clear
guidelines which avoid confusion and promote a professional
business relationship with anyone using this site. We aim
to do this by publishing our "Terms, conditions, disclaimer
and privacy policy."
1.2 The site "www.modelling4u.co.uk"
is administered by "NB Website Design". Throughout
this site, whenever the words "we", "us"
or "our" are used, they refer to the site administrator,
"NB Website Design". (To find out how to contact
us, please click here.) Whenever
the word "Terms" is used it refers to our "Terms,
conditions, disclaimer and privacy policy".
1.3 By using this site (including searching
for models) you are agreeing to be bound by all of the statements
in these Terms. If you do not agree with what you read in
any of these notices, you should not use this site.
1.4 We reserve the right to amend or update
these Terms at any time without prior notice and any changes
will come into effect immediately. By continuing to use this
site you are agreeing to accept any new or modified terms,
so please refer to this page from time to time.
1.5 If any provision in these Terms is invalid
or unenforceable, the remaining provisions will continue with
full force and effect. These Terms shall be governed by law
as if they were a contract wholly entered into and wholly
performed within England.

2. Disclaimer
2.1 Under no circumstances shall we be liable
for any direct, indirect, incidental or any other type of
loss or injury resulting from your use of any content on this
site or for the site being temporarily unavailable (for example
when updating information and systems maintenance). This includes,
but is not limited to, loss or injury caused in whole or in
part by our negligence or by contingencies beyond our control
in creating or delivering any portion of this site.
2.2 Any advice, guidance, information, products
or services sought from the people and organisations listed
is done at your own risk. We are not responsible nor liable
for any advice, guidance or information, given or implied,
nor for any claims made by any person or organisation listed
on this site (including standards of products, services, areas
of expertise, etc., or promises made by them), nor for any
defamatory, confidential, secret or other proprietary material
made available by them, nor for any damages suffered by you
or costs or financial losses you may incur (including, without
limitation, legal fees), as a result of using this site.
2.3 We cannot and do not warrant the completeness
or accuracy of the information contained in the listing details
of people or organisations or other content found on our site,
or its usefulness for any particular purpose. All information
provided is to be used on an "as is" basis without
warranty of any kind by us. We are not party to any warranties,
guarantees, promises or other arrangements described in any
listing details which give rise to contractual obligations.
These matters are solely between the people and organisations
listed and any person contacting them as a result of finding
their details on this site.
2.4 You use this web site, including contacting any people
or organisations listed, at your own risk.

3. Copyright
3.1 All of the content on this site is subject
to UK and international copyright laws. The site is maintained
and administered by "NB Website Design", in whose
name the copyright exists. Reproduction of the design and
images is not permitted without express written permission
from "NB Website Design", unless it is being
used for promotional purposes. However, you may print out
details of people and organisations listed for your own use
and convenience, and also registration forms and any pages
which you feel will help other people appreciate the benefits
of using this site.

4. Searching for models
4.1 In addition to the points made in the Disclaimer
section of these Terms, by using the facilities on this site
you are agreeing to the following:
- (a) You must not attempt to access any unauthorised
areas of this site.
- (b) You may not use any details listed on this site
to:
- (b.1) Post to, or transmit, any content that is abusive,
vulgar, obscene, hateful, fraudulent, unlawful, threatening,
harassing, or defamatory or which discloses private
or personal matters concerning any other person.
- (b.2) Post or transmit any advertising, promotional
materials, or other forms of solicitation including
chain letters or pyramid schemes.
- (b.3) Collect or store personal data about other users
of this site.
- (b.4) Post or transmit any file that contains viruses,
corrupted files, "Trojan Horses," or any other
contaminating or destructive features that may damage
someone else's computer.

5. People and organisations listed
5.1 If you or your organisation is listed on
this site, you are agreeing to the following:
- (a) We welcome all applications to be listed on this
site from sponsors and advertisers, and from models seeking
modelling and promotional work. (Note: Models must be
at least 18 years old to be listed on this site.) However,
we DO NOT permit entries which aim to solicit or encourage
any illegal or offensive activities. This includes, but
is not limited to, images which are sexually explicit
or pornographic.
- (b) When you submit your portfolio details, you are
giving us permission to publish that information on this
site. This may include using some of your images for promotional
purposes. However, application contact details are for
administration only and are kept secure and not
disclosed to anyone other than under legal obligations
imposed on us.
- (c) We reserve the right to decline a request to be
listed from any person or organisation and are not obliged
to provide reasons why such a request may be refused.
In addition, we reserve the right to remove people and
organisations from our lists at any time without explanation.
In these circumstances only, if you have paid an advertising
fee we will make a pro-rata refund of any fee paid by
you, the amount being dependent on the length of the current
unexpired listing period, the maximum amount not exceeding
the original listing fee.
- (d) We may reword details supplied to us if we believe
it will improve clarity and presentation and avoid unnecessary
repetition.
- (e) For models wishing to present their portfolio we
offer two options (see e.1 and e.2 below). For Option 1 there is a one-off set-up fee of £14.95. Hosting thereafter is provided FREE. In addition, no further commissions are
charged on work found by models as a result of being listed
on our site. Up to three amendments may be made each year
FREE of charge, the date starting from the date the portfolio
was originally listed. Further changes are charged at
£10 for each amendment.
- (e.1) Under Option One, we will create an individual
web page and assign it a unique name beginning with
"www.modelling4u.co.uk/profiles/". A thumbnail
image will be shown on our search
galleries which links to the model's web page that
we have created. A one-off set-up fee of £14.95 is payable for this option. Owing to our low cost administration structure, once the portfolio has been created we regret no refunds can be made. (Please note that from February 2007, hit counters will no longer be available on models' portfolios.)
- (e.2) Option two can be used if a model already
has his/her own web site for modelling and/or promotional work. Under this option we will
add the model's photograph to our search
galleries with a link to their own web site. This service is provided FREE of charge. (Note: We only provide links to personal web sites for modelling and/or promotional work, not to other modelling agencies' web sites. Email addresses are not permitted; neither are links to social networking sites such as "MySpace".)
- (e.3) Under both options, anyone submitting photographs
to us is also confirming that they have permission
from the copyright holder for us to use the image(s).
- (e.4) Agencies: Please note we are not resourced
to accept multiple applications from agencies.
- (f) When contacting us, either
through the site's online form or by email, please state
your application contact details in full (see forms on
our add your portfolio page),
including your security keyword. This information confirms
your identify to us.
- (g) We shall not be responsible or liable for any unsolicited
emails or other contact made by any vistors to this site
after accessing information provided by people and organisations
listed.
- (h) The people and organisations listed are responsible
for all statements made in the details provided to us
as part of our application procedure and for any acts
that occur as a result of other visitors contacting them.

6. Removing your name from our lists
- People and organisations listed who no longer wish to
be listed should let us know as soon as possible in order
to prevent unnecessary referrals being made to them and
for us to maintain a useful service to other people using
our site facilities. Owing to our low-cost structure,
we regret we are unable to provide refunds to advertisers
for any unexpired proportion of their current listing
period where the advertiser has asked us to remove their
details. We are also unable to refund any model's set-up fee once the portfolio has been created.
- As our portfolio hosting services are free, we reserve the right
to remove any model's portfolio without notice and without
explanation at any time.

Privacy policy
- "NB Website Design" is committed to protecting
and respecting your privacy. If you have any questions
or concerns in connection with this policy, you should
contact us.
- The information you provide to us will be used only
to process and fulfill your requests, and to complete
our administration procedures. The information you ask
us to display should be concise, informative and accurate.
Other information, such as invoice and correspondence
details, is kept securely and will not be made available
to any third party, other than required by law. By completing
our application procedure you are authorising us to make
public the information listed in your profile.
- We do our best to protect your personal information
after receiving it, but cannot ensure or warrant the security
of any information during its transmission to us.
- We will not disclose any information about individual
users, except to comply with applicable laws or valid
legal processes, or to protect the rights or property,
intellectual or otherwise, of "NB Website Design".
- We do not give, rent, lend, or sell individual information,
though we do summarise information. For example, we indicate
how many hits the site has had and may publish the total
number of people and organisations currently listed. Individuals'
details are never given out, other than under legal obligations
or as site listings for which permission has been granted
under the application process. We may also disclose aggregate
information in order to describe our services for publicity
purposes to other interested parties, and for other lawful
purposes.
- If you are listed on the site, we may from time to time
send you information relevant to your listing status.
Only we, or an agent acting on our behalf, will send you
this information. If you do not want to receive such correspondence,
you can let us know at the time and we will remove your
name from our mailing lists as soon as we can.
- Your listing details are accessible to the public. You
may as a consequence receive unsolicited messages from
other people and organisations not associated with this
site. We ask anyone visiting our site not to use your
information to send unsolicited advertising material,
but we have no control over them and cannot be held liable
or responsible if they choose to do this.
- Some of your feedback and comments may be published
on this site if we feel it will add value. If we do this,
we will do so without disclosing the precise source. For
example, we may list a comment under the name of "Lauren
B. from Newcastle".
- There are links on this site which may take you to other
sites outside our control. We have no responsibility or
liability for these sites, or for the policies they adopt.
